2012 Access Fees are now due:

            This is a courtesy notice to inform you that your 2012 Access fees are due. The Board of Directors approved an increase of $20 to the access fees for 2012 which was reviewed at the B.P.O.A. meeting in October. The new amount is $215 which is DUE for the property you own in Beechview Recreational Development, Clifton Tn. The Access fees are due now through June 1, 2012. Access fees must be paid for each and every occupied lot.  You owe at least one Access Fee even if your property is not being occupied/used. An occupied lot is defined as a lot that has a House (being used or not), Travel Trailer, or an RV on the lot for more than 2 weeks. If you have more than one Travel Trailer or RV on a lot for more than two weeks, you must pay an additional access fee (Pop-Up campers and Tents are not included) for each one. We will periodically check to see if there are more campers on the lots then what was paid for, so please pay up front so no further action has to take place.

            All payments received after the June 1st, 2012 date will be assessed a $25 late fee. If we do not receive payment, we will forward the names to our attorney for further legal action and you will be required to pay additional fees. If for some reason you believe that you do not owe an access fee (sold the property, paid already, or other reasons) please contact us in writing stating your claim and we will investigate it.

The website has our Covenants, ByLaws, Past Newsletters, Area Links and other useful information about our community. If you would like to add some of your pictures to our website or you would like to see anything added to it, please email us on the website.

 

B.P.O.A. Meetings:

       As per our By-Laws, the Board of directors has scheduled a B.P.O.A. meeting for Saturday April 7, 2012. This meeting will be held at the point at 10:00 am. This meeting is for the purpose of holding elections for the 2012 B.P.O.A. Board of Directors (as per our By-Laws). We will also review and distribute the 2011 expenditures and discuss future projects. All property owners who are current on their 2011 access fees are eligible to attend the meeting and run for one of the Board of Director positions. There will be a short meeting for the newly elected Board of Directors right after the standard B.P.O.A. meeting to elect the 2012 Officers.

            Don’t be one of those who sit back and complain and never come to the meetings or get involved. We need EVERYONE in our community to get involved so we can continue to make positive changes. So please plan on attending this important meeting.

           

The B.P.O.A. meetings for the remainder of the year are on the following dates and held at the point:

Saturday June 2, 2012 at 10:00am

Saturday August 4, 2012 at 10:00am

Saturday October 6, 2012 at 10:00am

 

Petition to abolish the B.P.O.A.:

            Some of you may have received a petition from Julian Moore regarding abolishing the B.P.O.A. I’d like to clear up some of the confusion that her and her attorney have regarding how we operate as a Board of Directors and the B. P. O A. Her attorney obviously had only the information that she had provided to him which was far from complete. In my opinion, it was unfair of him to give an opinion with the lack of information and misinformation that was provided to him. There are minutes for every decision, election and actions the B.P.O.A. has taken. The B.P.O.A. has operated within the confines of the laws pertaining property owners associations per our attorney. The letter pretty much made it clear that they are confused regarding how and what decisions are made by the Board of Directors and the B.P.O.A.

           

            Our By-laws that were reference in her letter dictate how we operate as Property Owners Association I.E.; Members in Good Standing, Elections, Quorums, Communications, Enforcement of the Covenants and Roles and Responsibilities. The decisions that the Board of Directors are responsible for are managing the access fee money and determining what maintenance and enhancements that need to be completed for the development as per the Assignment and Agreement (Addendum to the Covenants)  dated Oct. 2, 2000.  

            The Covenants (The Legal Document name is Conditions, Covenants and Restrictions) govern what you can and cannot do with your property I.E.; Building restrictions, Land use, Easements and Water & Sewer conditions. Any changes to the Covenants require two-thirds (2/3) of lot owners to agree to make a change. The past example of this was the collection of signatures of two-thirds (2/3)of lot owners that allowed toppers to be put over campers.

            The B.P.O.A. has NOT and does NOT make any decisions regarding changes to the Covenants. The B.P.O.A. is responsible for the enforcement of those rules only and any changes would require the two-thirds (2/3) vote of the Lot Property Owners.

            So as you can see there is a difference in the 2 documents and how we make decisions. The Board of Directors can agree that there are aspects of how the Covenants were set up that we don’t like as well.  But if we were to abolish the B.P.O.A. as suggested by Julian Moore, the management of the access fees would go back to the Beechview Corporation and they would be solely responsible for any maintenance and enhancements and increases to those fees without ANY involvement/voting of the Property Owners. The Beechview Corporation would only be required to come to us for a vote if there were any changes to the covenants which would require the two-thirds (2/3) vote .

             If you or anyone has a concern on how we are managing the B.P.O.A. please get involved, get on the board, and attend all of the meetings to know what is going on. I just wish the couple of Property Owners who have this issue would have spent their time, energy and money that was spent on this and re-direct it toward improving our community and stop living in the past. As the old saying goes: Be careful what you ask for…

 

ATV Traffic:

            We are asking that property owners to continue to monitor the speed of your children on ATV’s within Beechview. There are posted speed limit signs so please follow the speed limit so we do not have to get the local authorities involved. The last thing we all want is to have someone get hurt or personal property being destroyed.

      

The Bath House:

            The bath house will be opened this season from May 1st though October 31st. We are accepting bids for the bath house cleaning and grass cutting again this year. We ask that property owners who see anyone vandalizing the bath house or any property to contact a member of the Board of Directors as soon as possible.

Trash:

       The dumpster get emptied every other Friday. We want to make sure that all property owners are aware that these dumpsters are for normal household trash.. Building supplies and other miscellaneous big items are not allowed in the dumpster unless you talk to one of the Board of Director Officers and get approval.

 

Boat Ramp:

            Our dock is to be used for boaters to launch their boats. If you have a need to park your boat at the ramp it should not be left tied up for more than 15 minutes and it should NOT restrict other boaters from using the ramp. The dock is NOT to be used for swimming, fishing or any other purpose other than launching a boat.

 

Boat Trailer Parking:

            Only Beechview property owner vehicles with a watercraft trailer attached are allowed to park in the designated area. The trailers must have a Beechview sticker on the trailer or have a temporary visitor pass in their vehicle. Vehicles will be ticketed and repeat offenders will be towed at the owner’s expense. If you do not have a sticker for your trailer please see any one of the Board of Directors. Unauthorized vehicles without trailers are subject to be towed at the owner’s expense.

 

Road Projects:

            The 2011 Board of Directors agreed to take the money we had left in 2011 and carry it over to 2012 so we could complete a larger road repair project in 2012. We are going to try to have the work completed before the Memorial weekend if possible but that has to be finalized and approved by the new Board of Directors in April 2012.

 

In Closing:

            I’d like to thank everybody who has helped this past year by donating their time and efforts to improve our community. None of us are paid to serve on this board and we spend a lot of our own time on things that you the property owner never see.  We all do this because we have a common goal which is to improve our community. We ask that you get involved with your community either by attending meetings or volunteering for work that may be needed in our community. It should be the collective goal of all of us to make our community a better place for everyone to enjoy. So please make it a point in 2012 to get involved.

B.P.O.A. Meetings:

       As per our By-Laws, the Board of directors has scheduled a B.P.O.A. meeting for Saturday April 7, 2012. This meeting will be held at the point at 10:00 am. This meeting is for the purpose of holding elections for the 2012 B.P.O.A. Board of Directors (as per our By-Laws). We will also review and distribute the 2011 expenditures and discuss future projects. All property owners who are current on their 2011 access fees are eligible to attend the meeting and run for one of the Board of Director positions. There will be a short meeting for the newly elected Board of Directors right after the standard B.P.O.A. meeting to elect the 2012 Officers.

            Don’t be one of those who sit back and complain and never come to the meetings or get involved. We need EVERYONE in our community to get involved so we can continue to make positive changes. So please plan on attending this important meeting.

           

The B.P.O.A. meetings for the remainder of the year are on the following dates and held at the point:

Petition to abolish the B.P.O.A.:

            Some of you may have received a petition from Julian Moore regarding abolishing the B.P.O.A. I’d like to clear up some of the confusion that her and her attorney have regarding how we operate as a Board of Directors and the B. P. O A. Her attorney obviously had only the information that she had provided to him which was far from complete. In my opinion, it was unfair of him to give an opinion with the lack of information and misinformation that was provided to him. There are minutes for every decision, election and actions the B.P.O.A. has taken. The B.P.O.A. has operated within the confines of the laws pertaining property owners associations per our attorney. The letter pretty much made it clear that they are confused regarding how and what decisions are made by the Board of Directors and the B.P.O.A.

           

            Our By-laws that were reference in her letter dictate how we operate as Property Owners Association I.E.; Members in Good Standing, Elections, Quorums, Communications, Enforcement of the Covenants and Roles and Responsibilities. The decisions that the Board of Directors are responsible for are managing the access fee money and determining what maintenance and enhancements that need to be completed for the development as per the Assignment and Agreement (Addendum to the Covenants)  dated Oct. 2, 2000.  

            The Covenants (The Legal Document name is Conditions, Covenants and Restrictions) govern what you can and cannot do with your property I.E.; Building restrictions, Land use, Easements and Water & Sewer conditions. Any changes to the Covenants require two-thirds (2/3) of lot owners to agree to make a change. The past example of this was the collection of signatures of two-thirds (2/3)of lot owners that allowed toppers to be put over campers.

            The B.P.O.A. has NOT and does NOT make any decisions regarding changes to the Covenants. The B.P.O.A. is responsible for the enforcement of those rules only and any changes would require the two-thirds (2/3) vote of the Lot Property Owners.

            So as you can see there is a difference in the 2 documents and how we make decisions. The Board of Directors can agree that there are aspects of how the Covenants were set up that we don’t like as well.  But if we were to abolish the B.P.O.A. as suggested by Julian Moore, the management of the access fees would go back to the Beechview Corporation and they would be solely responsible for any maintenance and enhancements and increases to those fees without ANY involvement/voting of the Property Owners. The Beechview Corporation would only be required to come to us for a vote if there were any changes to the covenants which would require the two-thirds (2/3) vote .

             If you or anyone has a concern on how we are managing the B.P.O.A. please get involved, get on the board, and attend all of the meetings to know what is going on. I just wish the couple of Property Owners who have this issue would have spent their time, energy and money that was spent on this and re-direct it toward improving our community and stop living in the past. As the old saying goes: Be careful what you ask for…

 

ATV Traffic:

            We are asking that property owners to continue to monitor the speed of your children on ATV’s within Beechview. There are posted speed limit signs so please follow the speed limit so we do not have to get the local authorities involved. The last thing we all want is to have someone get hurt or personal property being destroyed.

      

The Bath House:

            The bath house will be opened this season from May 1st though October 31st. We are accepting bids for the bath house cleaning and grass cutting again this year. We ask that property owners who see anyone vandalizing the bath house or any property to contact a member of the Board of Directors as soon as possible.

Trash:

       The dumpster get emptied every other Friday. We want to make sure that all property owners are aware that these dumpsters are for normal household trash.. Building supplies and other miscellaneous big items are not allowed in the dumpster unless you talk to one of the Board of Director Officers and get approval.

 

Boat Ramp:

            Our dock is to be used for boaters to launch their boats. If you have a need to park your boat at the ramp it should not be left tied up for more than 15 minutes and it should NOT restrict other boaters from using the ramp. The dock is NOT to be used for swimming, fishing or any other purpose other than launching a boat.

 

Boat Trailer Parking:

            Only Beechview property owner vehicles with a watercraft trailer attached are allowed to park in the designated area. The trailers must have a Beechview sticker on the trailer or have a temporary visitor pass in their vehicle. Vehicles will be ticketed and repeat offenders will be towed at the owner’s expense. If you do not have a sticker for your trailer please see any one of the Board of Directors. Unauthorized vehicles without trailers are subject to be towed at the owner’s expense.

 

Road Projects:

            The 2011 Board of Directors agreed to take the money we had left in 2011 and carry it over to 2012 so we could complete a larger road repair project in 2012. We are going to try to have the work completed before the Memorial weekend if possible but that has to be finalized and approved by the new Board of Directors in April 2012.

            I’d like to thank everybody who has helped this past year by donating their time and efforts to improve our community. None of us are paid to serve on this board and we spend a lot of our own time on things that you the property owner never see.  We all do this because we have a common goal which is to improve our community. We ask that you get involved with your community either by attending meetings or volunteering for work that may be needed in our community. It should be the collective goal of all of us to make our community a better place for everyone to enjoy. So please make it a point in 2012 to get involved.

BEECHVIEW’S 2011 NEWSLETTER

 

                We are excited for the summer camping season to start. This newsletter will describe the Beechview events and dates for this calendar year. Due to the ongoing cost this will be the only notification you will receive from the B.P.O.A. this year which includes your access fee notice. Please check our website at www.beechview.net  for any updates to our community. Please keep a copy of this newsletter to remind yourself of the B.P.O.A. Meetings and events.

           

2011 Access Fees are now due:

            This is a courtesy notice to inform you that you’re 2011 Access fees in the amount of $195 are DUE for property you own in Beechview Recreational Development, Clifton Tn. The Access fees are due now through June 1, 2011. Access fees must be paid for each and every occupied lot.  You owe at least one Access Fee even if your property is not being occupied/used. An occupied lot is defined as a lot that has a House (being used or not), Travel Trailer, or an RV on the lot for more than 2 weeks. If you have more than one Travel Trailer or RV on a lot for more than two weeks, you must pay two access fees (Pop-Up campers and Tents are not included). We will periodically check to see if there are more campers on the lots then what was paid for so please pay up front so no further action has to take place.

            All payments received after the June 1st, 2011 date will be assessed a $25 late fee. If we do not receive payment, we will forward the names to our lawyer for further legal action. If for some reason you believe that you do not owe an Access fee (sold the property, paid already, or other reasons) please contact us in writing stating your claim and we will investigate it.

Beechview Property Owners Association Address:

            Currently we still have the P.O. Box 866 address for the B.P.O.A. but we will be installing a locking Mailbox across from the Bath House this spring. Our new address after June 1, 2011 will be 198 Beechview Drive. Property Owners will be able to drop their Access Fee’s in that Mailbox in the future. In the meantime please continue to use the P.O. Box 866 for any mailings to the B.P.O.A. until after June 1, 2010.

4th of July Fireworks:

            The annual Beechview fireworks show will be on Sunday July 3rd at dust in the same location as last year. If anyone would like to donate to the firework show please contact any one of the board members.

 

Beechview’s Annual “Chili Fest”:

            All property owners and their guest are invited to our annual “Chili Fest”. Please bring your favorite chili dish, serving spoon, and lawn chairs. The B.P.O.A. will provide drinks, bowls and other necessary items. If you are cooking challenged, come anyway there is always more than enough. The event is scheduled for Saturday October 1, 2010 at 1:00pm at the point. In case of rain we will try again Sunday, same time. Any questions please contact Ann Farrell. RV Lots for Rent:

       Beechview Corporation has RV lots for rent next to the bath house. These lots have water and electric and are rented by the day, week, month or the summer season. Please call (931) 676-7421 for reservations.

 

T-Shirts:

            We are going to research the cost of selling T-Shirts with the Beechview name on them with a couple of different artwork styles to choose from. This will be reviewed by the Board of Directors and if approved we will post the details on the website.

If you have more than one Travel Trailer or RV on a lot for more than two weeks, you must pay two access fees (Pop-Up campers and Tents are not included).

New Boat Dock:

                The Board of Directors has approved the purchase of a new dock. Anybody who used the dock last year knows the safety hazards we had with the dock. At the time of this publication the fabrication is completed on the new dock and dismantling of the old will take place shortly and the new dock will be installed thereafter. The board has agreed to conduct a silent auction for the entire old dock which will be stacked up near the dumpster. It will be the new owner’s responsibility to have it moved within two weeks after the auction has ended. Any property owner s who is interested in the old dock can place a bid on it by submitting in writing their bid including their name and lot number and mail it to the above address no latter then April 2, 2010. We will announce the winner at the B.P.O.A. Meeting.

In Closing:

             I like to thank everybody who has helped and donated their time and effort since I’ve served as President.  I Plan on stepping down as President at the April meeting and I will work with the new leadership to ensure there is a smooth transition. I can say that I’m proud of the improvements that we as a Board have made to our community such as; New boat ramp, New boat dock, New signage, Road improvements, Bylaws rewritten that allows for all owners to participate in B.P.O.A. meetings, New website, Bath House Painted and kept clean, and Improved trash capacity. Property Owners Meeting:

            We would like to invite all property owners and their guest to our annual “Chili Fest”. Please bring your favorite chili dish, serving spoon, and lawn chairs. The B.P.O.A. will provide drinks, bowls and other necessary items. If you are cooking challenged, come anyway there is always more than enough. The event is scheduled for Saturday October 3rd at 1:00pm at the point. In case of rain we will try again Sunday, same time. We had a great turn out last year and we are looking for a better turn out this year. Any questions please contact Ann Farrell. Hope to see you all there.
 
Gate System for Beechview:
       After several discussions and research done on the cost of an installed gate system, the Board of Directors have agreed to table the issue at the present time. There are a few significant issues that have to be addressed. The main request for a gate system was for security purposes, but after discussions at the board meeting we uncovered 2 other entrances into Beechview from BeechCreek Loop. Anybody could still access Beechview through anyone of those entrances. There are a few other issues regarding breakdowns (Who maintains and overrides the system in the event of a breakdown on any given day or night) and the on-going maintenance cost.  Until we can solve these issues we cannot provide you, the property owners the information needed to make an informed decision. We will keep the property owners updated on the gate system as these issues are resolved.

Boat Ramp Update:
                The boat ramp is still under construction. We have had issues with 2 different contractors that were to complete the project. At this time we lack a 12’ to 14’ section that has to be poured. Tony Clark and Eric Potts agreed to finish this project and have volunteered a lot of time and effort to getting this project done. We have run into a problem with the water levels being too high to complete the concrete work. Worst case is that we will have to pour some crushed gravel between the sections so the ramp can be used this summer and then pour the rest of the concrete in the fall. We will have a useable ramp for this summer. The hump at the end of the ramp is gone and we have added length to the end of the ramp which will help launching your boats during lower water levels. Remember if you do not have a sticker for your boat trailer please see Tony Mills on River Rd or email us with your request. Unauthorized vehicles are subjected to be stickered and towed at the owner’s expense.

Property Owners Meeting:
            The B.P.O.A. had a meeting for all property owners on Saturday August 23, 2008 and we had approximately 50 people attend. The purpose of the meeting was to discuss the board’s ideas for improvements for 2009 to the roads, bath house, boat ramp, access fees requirements for 2009, and etc. We were pleasantly surprised at the number of property owners that attended the meeting and we hope to get more owners involved in improving our community. One of the things that were discussed was the increase in the access fees for 2009. The access fees will be increase to $195 for 2009. As a board it was also agreed that we will not charge the $35 membership fee for joining the B.P.O.A. Once a Property Owners has paid their access fees they would become members of the B.P.O.A. and have rights as a member under our Bylaws. Information on the 2009 access fees which are due starting in January through June 1st, 2009 will be
mailed out in December.

Boat Ramp Update:
       We are currently working on making improvements to the boat ramp. By the time you receive this letter we hope that work on the ramp will have begun if Mother Nature cooperates. The plan is to cut out the hump at the bottom of the ramp and leveling out the slope. We are also adding on to the end of the ramp which will help launching your boats during low water levels. Stay tuned for further updates.
